Terms and Conditions for MagniTech Marketing
Effective Date: January 1, 2025
Welcome to MagniTech Marketing! By using our website and services, you agree to the following Terms and Conditions. Please read them carefully.
1. Acceptance of Terms
By accessing or using any part of the MagniTech Marketing website or services, you agree to be bound by these Terms and Conditions, as well as any additional terms that may apply. If you do not agree to these terms, please refrain from using our services.
2. Services Provided
MagniTech Marketing offers a variety of digital marketing services, including but not limited to SEO, website development, social media management, reputation management, Google Ads management, press releases, and listing management. The specific scope of services will be outlined in individual agreements and service contracts.
3. User Responsibilities
You agree to provide accurate, up-to-date, and complete information when using our services. It is your responsibility to maintain the confidentiality of your account and to notify us immediately if you suspect any unauthorized use of your account.
4. Payment and Billing
Our pricing structure is detailed in the service agreement you sign with us. Payments for services are due as outlined in your agreement, and failure to make timely payments may result in service interruption or cancellation. If you are on a subscription or ongoing service plan, you agree to automatic billing as per the agreed-upon payment schedule.
A five (5) day grace period is provided following the payment due date. After this grace period, any outstanding balance will incur a two percent (2%) increase. This increase will continue to compound monthly at a rate of 2% on any unpaid balance until the account is brought current.
If any payment remains unpaid for more than thirty (30) days, all services will be paused and suspended until the outstanding balance is paid in full. MagniTech Marketing reserves the right to withhold deliverables, access, and ongoing work during any period of non-payment.
Full website payment is required prior to the website going live unless a payment plan has been agreed upon in writing.
5. Free Trial Offer
If you are utilizing a free trial offer for any of our services, you understand that the free trial is limited to the specified duration (e.g., 3 days). After the trial period, charges will apply unless the service is canceled before the trial ends. You are responsible for ensuring that the service is canceled if you do not wish to continue.
6. Cancellation and Refund Policy
You can cancel services at any time before development or before services begin, excluding recurring services, by notifying MagniTech Marketing in writing. For recurring services cancellation must be requested in writing 30-days in advance. However, all payments made are non-refundable. Certain services, such as job listings or website design, may have separate cancellation policies that are outlined in your contract.
7. Intellectual Property
All content, designs, logos, text, and materials produced by MagniTech Marketing are the intellectual property of the company, unless otherwise agreed upon in writing. You may not reproduce, distribute, or use any of our intellectual property without explicit permission.
8. Privacy and Data Security
We take your privacy seriously. All personal and business data provided to us will be handled according to our Privacy Policy. You agree that we may collect and use your information for the purpose of delivering services and improving our offerings.
9. Limitations of Liability
MagniTech Marketing will not be liable for any indirect, incidental, special, or consequential damages arising from the use of our services, website, or the inability to use them. We make no guarantees regarding the results of our services, including SEO rankings or business performance.
10. Indemnification
You agree to indemnify and hold MagniTech Marketing harmless from any claims, damages, or losses resulting from your use of our services or any violation of these Terms and Conditions.
11. Modifications
MagniTech Marketing reserves the right to modify or update these Terms and Conditions at any time. Any changes will be posted on this page, and it is your responsibility to review these terms regularly. Continued use of our services after any changes constitutes your acceptance of the updated Terms and Conditions.
12. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of the jurisdiction in which MagniTech Marketing operates. Any disputes will be handled in the appropriate courts within that jurisdiction.
13. Ongoing Service Terms
- All hosting and management services require a minimum six (6) month commitment.
- After the initial term, services will continue on a month-to-month basis unless canceled with a thirty (30) day written notice.
14. Project Scope & Change Policy
- Minor content or design adjustments are only permitted during the mockup stage of a website.
- Once the mockup is approved, additional changes will require additional compensation.
- Major changes (including but not limited to new pages, full redesigns, or structural changes) will be separately scoped and billed.
- The determination of whether a change is minor or major is at the sole discretion of the Account Manager.
- Any feature, structural adjustment, or functionality request introduced after development has begun will require timeline adjustments and additional costs prior to implementation.
15. Project Scope & Change Policy
- The client must provide timely access, content, and approvals to maintain the agreed project timeline.
- If responsibilities (excluding payment obligations) are not met by either party, a thirty (30) day grace period will be provided to resolve the issue.
- If unresolved after this period, the project may be paused or terminated at the discretion of MagniTech Marketing.
16. Product Representation & Manufacturing Disclaimer
MagniTech Marketing is responsible solely for website design, development, and digital marketing execution.
MagniTech Marketing is not responsible for:
- Product quality
- Manufacturing defects
- Product/Service authenticity
- Mechanical functionality
- Material durability
- Fulfillment, shipping, or warranty claims
All product descriptions, material claims, and quality representations are provided by you and your manufacturing partners. You assumes full responsibility for all product-related claims, warranties, and customer satisfaction regarding physical goods sold.
